Federal Agencies

  • The Federal Deposit Insurance Corporation (“FDIC”) – our results have led to MMV being considered the FDIC’s go-to firm in Puerto Rico. Among our engagements for the FDIC have been:

    • Co-counsel in the professional liability lawsuits against certain former officers and directors of two banks seeking over $200 million in damages. This includes direct actions against insurers to recover on professional liability policies.

    • Co-counsel in several multi-million-dollar Loss Share Agreement disputes currently in arbitration.

    • Local counsel in fidelity bond cases against an insurer.

    • Counsel in various commercial real estate multi-million-dollar foreclosure actions- successfully foreclose and/or reached favorable settlements in every one; also successfully dismissed numerous counterclaims.

    • Counsel in various lender liability lawsuits- successfully dismissed every single one.

    • Co-counsel in the professional liability investigation that included criminal investigations in close cooperation with the FDIC Office of the Inspector General.

    • Local counsel in a successful administrative FDIC Enforcement Action, which resulted in two Orders of Prohibition.

  • The Federal Home Loan Mortgage Corporation (Freddie Mac)- Litigation involving a commercial real estate foreclosure and the successful dismissal of an over $14 million counterclaim.

  • Legal Counsel for Examiners and Receivers in U.S. Bankruptcy Court Cases

  • Legal Counsel for Bankruptcy Examiners in the cases of In re: Maxon Engineering Services, Inc. and In re: Hermanos Torres Pérez, Inc.

  • Legal Counsel for Trigild, Inc., a U.S. Bankruptcy Court-appointed receiver and nation-wide real estate management firm. MMV assisted in the administration of multi-million-dollar real estate developments under foreclosure and all related litigation.

  • Medical Card Systems-HMO Inc. (“MCS”)– Counsel in litigation involving torts, fraud claims against insureds and other matters related to HMOs including matters related to the healthcare industry before the administrative forums, the local courts and the USDC-PR including litigation for several millions of dollars against independent practice associations.

  • Hertz Claims Management – Counsel in litigation involving torts in products liability and accidental deaths as well as general torts related to automobile accidents in Puerto Rico and in South Florida.

  • Dollar Rent a Car– Consulting on commercial litigation issues for the local franchisee, including Law 75 regarding distributors and corporate matters.

  • Flextronics of Puerto Rico Ltd. (a manufacturer of electronic components)- labor litigation and consulting.

  • Russell Stover Candies, Inc.– counsel in commercial and labor litigation.

  • ServiceNet (an AIG company)- in consulting and litigation of corporate, commercial, and insurance matters before administrative agencies.

  • SP Plus Corp. (formerly Central Parking Systems) (the publicly traded leading parking management service in North America). Consulting of various corporate, commercial, labor and employment matters and litigation involving various labor, employment, real estate and commercial issues in administrative, state and federal forums. MMV has also provided advice on real estate transactions for over 20 years.

  • Toyota de Puerto Rico– labor litigation and consulting.

  • Telemundo (a Hispanic television network owned by NBC)– counsel in employment litigation.

  • Twentieth Century Fox– Consulting on trademark issues and registration.

  • Unisys– counsel on labor law litigation and issues.

  • Volunteers of America– represented the owner of a housing for the elderly project in a construction dispute where the General Contractor filed for bankruptcy, several subcontractors filed claims and the specific performance of the construction bond was at issue.

Local Businesses

  • Alberic Colón Auto Group (one of the largest car dealers on the island representing General Motors, Chrysler, Ford and Mitsubishi)- consulting on general legal issues as well as litigation involving corporate, real estate and commercial issues including Law 75. Among other things, MMV successfully defended the right of Alberic Colón to exercise an option agreement for several million dollars over a property in Kennedy Ave.

  • City and Castle Enterprises– Successfully defended and settled dispute between owners of a multilevel parking garage registered as a condominium with several issues ranging from incorrect inscription of the parking spaces to encroachment by one owner, to payment of property taxes.

  • Hotel Meliá (local hotel in Ponce, Puerto Rico)- counsel in successful trademark litigation against the Spanish entity Hotel Gran Meliá. Successfully obtained the reversal of an adverse decision on appeal before U.S. Court of Appeals for the First Circuit.

  • Leaseway (Car and truck rental and leasing company)– counsel in corporate matters and several real estate transactions including acquisitions and sale of commercial properties.

  • Paragon Development and Desarrollos Planificados– litigated construction issues with subcontractors in arbitration before the American Arbitration Association’s ICDR for low income housing projects of over 500 units in Naguabo, Puerto Rico.

  • Puerto Nuevo Development Corporation- Successfully prosecuted a claim against a community of squatters encroaching on an industrial property of over 50 acres in the metropolitan area.

  • Rams Imports, Inc. (A wholesaler of clothing and retailer of jewelry in several jurisdictions)- counsel in federal and state trademark and copyrights litigation as well as commercial and employment issues. Consulting in real estate matters for acquisitions of commercial buildings in and outside Puerto Rico.

Puerto Rico Government Institutions

  • Comprehensive Cancer Center for the University of Puerto Rico– counsel to the Board of Directors on several corporate governance issues; also assisted in the permits process for the development of a $200,000,000 clinical facility.

  • Instituto de Cultura Puertorriqueña (Institute of Puerto Rican Culture)– commercial and labor consulting and litigation including advising on the restructuring and reduction of this agency via Act No. 7 of March 2009.
